Landlords

The introduction of the Tenancy Deposit Scheme on 6th April 2007 means that Landlords now have to provide evidence when a claim is made against the tenants deposit.

In some cases, deposit disputes can be resolved between the Landlord and tenant without the need of an adjudicator. When an agreement cannot be reached this is likely because evidence cannot be provided to prove a deduction should or shouldn't be made from the deposit. If this is the case, an adjudicator from the deposit protection scheme will assess the case and determine how the deposit is awarded based solely on the evidence that can be provided.

Inventories are not a legal requirement and we understand that admin costs have risen for Landlords over the years so it can be tempting to save on the cost of an inventory. However in practice they are an essential part and most effective way of protecting yourself against the high repair costs that can come from not being able to prove damage wasn't there at the start of the tenancy.

Having an inventory is the best way to avoid an unfair dispute which clearly states the condition the property was in at the start of the tenancy, with clear supporting photographs. With years of experience handling inventories and checkouts, we know the best way to present an inventory as well as all the details and terminology that must be included. We not only supply photos of areas noted in the inventory, but take photos of all areas of the property so easy comparisons can be made at the end of the tenancy, eliminating any room for disagreement.

Our experience has also taught us that it is highly beneficial for a third party to carry out the inventory or checkout. In some cases, tenants can assume the report is bias if carried out by the Landlord or Agency, making any deposit negotiations difficult at the end.
